Netflix Reality Casting Privacy Statement

This Reality Casting Privacy Statement explains our practices regarding the collection, use, and disclosure of certain information, including your personal information, by Netflix. This Privacy Statement applies to all of our casting practices, associated tools, and related services (“Services”) that link to this privacy statement. Additional privacy information and terms may apply depending on which Services you use, as noted below. For clarity, residents of the UK/EEA are deemed to have acknowledged (rather than agreed to) the Privacy Statement.

Collection of Information

We receive and store information about you such as:

  • Information you provide to us: We collect information you provide to us which includes your name, date of birth, address, email address, telephone number, social media handle, your picture, and information included in your CV/resume or your submissions. We collect this information in a number of ways, including when you enter it while using our services or interact with us.

  • Information we collect automatically: We collect information about you and your use of our Services, your interactions with us, as well as information regarding your computer, mobile device or other device used to access our service. This information includes:

    • your activity on the Services, including feature use;

    • details of your interactions with us, such as the date, time and reason for contacting us;

    • device IDs or other unique identifiers;

    • device and software characteristics (such as type and configuration), connection information, statistics on page views, referral URLs, IP address (which may tell us your general location), browser and standard web server log information;

    • information collected via the use of cookies, web beacons and other technologies. See our Cookies section for more details.

We may also collect and use "special” or “sensitive” personal information, which means personal information relating to your trade union membership, health, criminal convictions and history, ethnicity, religion, sexual orientation, or political persuasion. Where such personal information is required we will only process this as follows (if local law permits):

  • where we have your explicit consent;

  • where it is necessary for carrying out our obligations and exercising our rights in the field of employment, social security or social protection law or collective agreement;

  • where it is necessary for the assessment of your working capacity;

  • where it is necessary for reasons of substantial public interest;

  • where required under a specific legal obligation; or

  • where you have manifestly made this information available to us.

Use of Information

We use information to communicate with you and respond to your interest, and to consider your application to be a participant in our production. We further use information to provide, analyze, administer, and enhance our Services, and to process your application. We also use information for: troubleshooting; audit logging; to prevent, detect and investigate potentially prohibited or illegal activities, including unauthorized access; comply with legal requirements and law enforcement requests; and to generate usage statistics.

Retention

Netflix will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements, and destroy the information in a way that is impossible to restore the information to its original state. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

Disclosing your personal information

We may disclose your personal information among the Netflix family of companies (help.netflix.com/legal/corpinfo) and certain third parties to process your personal information on our behalf. In each case, we will ensure that all such parties only process your personal information in accordance with this Privacy Statement.

We may also disclose your personal information to our production partners who are producing a particular property for us.

We may also disclose your personal information in the following circumstances under applicable laws:

  • where if we believe that doing so is necessary to protect the rights, property, security, or safety of us, our production, our other talent and crew, or the public;

  • to enforce any contract or policies we have in place with you;

  • to investigate and defend ourselves or others against any third-party claims or allegations; and

  • in relation to a business transaction, such as a merger, change of control or sale of assets.

Whenever in the course of sharing information we transfer personal information to countries outside of the European Economic Area and other regions with comprehensive data protection laws, we will ensure that the information is transferred in accordance with this Privacy Statement and as permitted by the applicable laws on data protection.

Security

We use reasonable administrative, logical, physical and managerial measures to safeguard your personal information against loss, theft and unauthorized access, use and modification. These measures are designed to provide a level of security appropriate to the risks of processing your personal information.

Minors

Unless otherwise provided, you must be 18 years of age or older to use the Services. We will designate if Services are directed at persons under the age of 18. In certain jurisdictions, the age of majority may be older than 18, in which case, you must satisfy that age requirement.

Changes to This Privacy Statement

We will update this Privacy Statement from time to time in response to changing legal, regulatory or operational requirements. We will provide notice of any such changes (including when they will take effect) in accordance with law. Your continued use of the Services after any such updates take effect will constitute acknowledgement and (as applicable) acceptance of those changes. We and our service providers use cookies and other technologies (such as web beacons) for various reasons. For example, we use cookies and other technologies to make it easy to access our Services by remembering you when you return, and to provide and analyze our Services. We want you to be informed about our use of these technologies, so this notice explains the types of technologies we use, what they do and your choices regarding their use.

1. What are cookies?

  • Performance and funcitonality cookies: These cookies are not essential, but help us to personalize and enhance your online experience with the Services. We also use these cookies to collect information (such as click-through and other information) about use of the Services so that we can enhance and improve our Services. 3. How Do We use Web Beacons and other Technologies?

Web beacons (also known as clear gifs or pixel tags) often work in conjunction with cookies. We and our service providers may use them for similar purposes as cookies, such as to understand and enhance the use of our service, improve site performance, and monitor visitor traffic and actions on our site. Because web beacons often work in conjunction with cookies, in many cases, declining cookies will impair the effectiveness of web beacons.

We use other technologies that are similar to cookies, such as browser storage and plugins (e.g., HTML5, IndexedDB, and WebSQL). Your information and rights

Our legal basis for collecting and using the personal information described in this Privacy Statement will depend on the personal information concerned, the applicable data protection law and the specific context in which we collect and use it. We will normally collect personal information from you where we need the personal information to perform a contract with you (for example, if we retained you as a participant on a production), where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms (for example, contacting you in connection with opportunities to work on a production), or where we have your consent to do so (for example, collecting information about your diversity). In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person (for example, to confirm your identity). You can request access to or deletion of your personal information, or correct or update out-of-date or inaccurate personal information we hold about you. To make requests, or if you have any other question regarding our privacy practices, please contact our Data Protection Officer/Privacy Office. When contacting us, please be sure to advise us that you are contacting us in connection with these Services. We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. We may reject requests that are unreasonable or not required by law, including those that would be extremely impractical, could require disproportionate technical effort, or could expose us to operational risks.

Please be aware that the rights above are not absolute and there may be circumstances where we are unable to comply with your request (either wholly or in part). In such cases we will explain why we cannot comply with the request.

We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is another appropriate security measure to ensure that personal information is not disclosed to any person who has no right to receive it.

California Consumer Privacy Act (CCPA) Reality Casting Privacy Statement

This Privacy Statement applies to California consumers, and supplements the Reality Casting Privacy Statement.

Personal Information We Collect

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“CCPA personal information”). We have collected the following categories of CCPA personal information from consumers within the last twelve (12) months:

  • Identifiers: “Identifiers” covers a broad range of information, including things like name, email address, postal address, telephone number, IP address. We collect some CCPA personal information that falls into this category. For example, when you apply to be a participant in a production, we’re going to collect your name, email address, phone number, your birthday, and your postal address as part of the application process. We also collect IP addresses when you connect to our site.

  • Characteristics of protected classifications under California or federal law: This covers a broad range of information like race, citizenship status, sex, gender identity, marital status, sexual orientation, military status or whether you are a veteran, religion, political affiliation, and whether you are a person with a disability. When you apply, you may provide information about such characteristics.

  • Internet or other electronic network activity information: Our application process is online, so we collect CCPA personal information in this category, like your interactions with our site.

  • Geolocation data: Our site does not collect precise geolocation data from GPS sensors, which is what we understand this term to mean. However, as noted above, we do collect IP addresses from which we can determine your general location.

  • Audio, electronic, visual, thermal, olfactory or similar information: If you visit our facilities, your entry and exit from lobbies and other areas of our facilities may be monitored by CCTV.

  • Professional or employment-related information: As part of the applicant screening process, we collect CCPA personal information in this category, like information on your resume.

Uses of CCPA Personal Information

We use the categories of CCPA personal information listed above for the purposes noted in the Use of Information section of our Reality Casting Privacy Statement. For ease of reference, we repeat that section below:

  • We use information to communicate with you and respond to your interest, and to consider your application to be a participant in our production. We further use information to provide, analyze, administer, and enhance our Services, and to process your application. Categories of CCPA personal information disclosed for a business purpose

We disclose categories of CCPA personal information for business purposes. (Please see the Disclosure of Information section of our Reality Casting Privacy Statement for additional details that may be of interest to you.)

Sensitive Personal Information

CCPA personal information may include information that may be considered Sensitive Personal Information as defined by the CCPA. We do not use or disclose Sensitive Personal Information for any purpose inconsistent with section 7027 (l) of the CCPA Regulations

We explain our sources of information in the Collection of Information section of the Reality Casting Privacy Statement. (Please see that section for more information that may be of interest to you.) For ease of reference, in regard to CCPA personal information these are:

  • Information you provide to us: We collect information you provide to us which includes your name, date of birth, address, email address, telephone number, social media handle, your picture, and information included in your CV/resume or your submissions. We collect this information in a number of ways, including when you enter it while using our services or interacting with us (see “Sensitive Personal Information” above).

  • Information we collect automatically: We collect information about you and your use of our Services, your interactions with us, as well as information regarding your computer, mobile device or other device used to access our service.

Your rights under the California Consumer Privacy Act

  • You have the right to know what categories and specific pieces of CCPA personal information have been collected about you; the categories of sources from which CCPA personal information are collected; our business or commercial purpose for collecting, using, or disclosing CCPA personal information; the categories of third parties with whom we share CCPA personal information; the categories of CCPA personal information we have disclosed about you for a business purpose. You have a right to confirm whether or not we process your CCPA personal information as well as to access and receive a copy of the specific CCPA personal information we have collected about you.

  • You have a right to request the deletion of your CCPA personal information, subject to exceptions under the CCPA.

  • You have a right to request correction of any inaccurate CCPA personal information we hold about you.

  • You have the right to receive notice of our practices at or before collection of CCPA personal information (for example, this notice) and not receive discriminatory treatment or be retaliated against if you choose to exercise any of your rights.

We do not sell or share CCPA personal information. We do not knowingly sell, share or use the personal information of minors under 16 years of age.

You can assert these rights only where we receive a verified request from you. To make requests, or if you have a question regarding our privacy practices, please contact our Data Protection Officer at corporateprivacy@netflix.com. If you wish to contact us through an authorized agent, the authorized agent can submit a request on your behalf to corporateprivacy@netflix.com along with a statement, certified as may be required, that the agent is authorized to act on your behalf. In order to verify the request, we may ask you to verify your identity.

Data Retention

We will only retain your CCPA personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
