Supplemental Terms & Conditions for Beta Features

These Supplemental Terms & Conditions ("Supplemental Terms & Conditions") apply to beta features that may be made available by Netflix, Inc. (“Netflix,” “we,”“us” or “our”) to you, an advertiser or agency on an advertiser’s behalf (“you” or “your”). When you purchase or use our ad products or services, you agree to these Supplemental Terms & Conditions, which are also incorporated by reference into your agreement to purchase advertising media on Netflix. In the event of any conflict with such agreement, these Supplemental Terms & Conditions will control.

Beta Features

From time to time, Netflix may make available to you certain features identified as “Alpha” or “Beta” or otherwise as being in development or unsupported in connection with Netflix’s advertising supported service (“Beta Features”). As between the parties, we retain exclusive ownership of each Beta Feature. (By way of example, sponsorships will launch on Netflix as a Beta Feature.)

Disclaimer

Since each Beta Feature is still in a trial phase, it may contain errors and you acknowledge and agree that the Beta Features and any data we provide to you in connection with your use of the Beta Features are on an "AS IS" and "AS AVAILABLE" basis.

Limited Use

You may only use Beta Features as authorized. You acknowledge and agree that we may change, withdraw, terminate your use of, or discontinue any Beta Features, or any portion thereof, at any time and in our sole discretion, with or without notice to you.

Feedback

If you provide any feedback to Netflix concerning the functionality, enhancements and changes to the Beta Features (e.g. identifying errors and potential improvements), then Netflix may use that feedback without further obligation or compensation to you.

Marketing Materials Release

To the extent Netflix makes available a Beta Feature to you, and you choose to utilize the Beta Feature, you grant Netflix the right to use, display, publish, excerpt from, and reproduce the materials that you create and use in connection with the Beta Feature, including any ad materials, brand names, trademarks, trade names, service marks, copyrights, and/or related performance data, worldwide, in perpetuity, without further obligation or compensation to you, for the purpose of promoting our advertising products and services (e.g., in case studies and sales collateral materials).

Miscellaneous

We may modify these Supplemental Terms & Conditions at any time, and by continuing to access, test, or use the Beta Feature after any modification to these Supplemental Terms & Conditions, you agree to be bound by them.
